The “innocence.boutique” website and associated services are made available to you in accordance with the following General Terms and Conditions (“GTC”). Before placing an order on www.innocence.boutique, please read the General Terms and Conditions carefully. We recommend that you keep a copy of the General Terms and Conditions for future reference. We offer personalized shopping on www.innocence.boutique that meets your interests and specific needs.

1. SCOPE

1.1 These General Terms and Conditions apply to all orders placed by consumers on the site www.innocence.boutique.

1.2 You acknowledge having read, prior to sending your order, these General Terms and Conditions and having reviewed all the information listed in article L.221-5 of the French Consumer Code in a readable and understandable manner. Confirmation of your order implies unreserved acceptance of these General Terms and Conditions.

2. EXECUTING THE CONTRACT AND DELIVERIES

2.1 On the site www.innocence.boutique, contracts are exclusively executed in French. Whenever you order items, your co-contractor is CABESSA SARL, 1 BD Gambetta, 67000 Strasbourg.

2.2 The essential characteristics and the price of our products are indicated on the pages containing the detailed description of the products of the online store. The "confirm order" button allows you to confirm your order which then becomes final, and a sales contract is thus executed. Please note that the delivery of ordered products is made against advance payment (reservation)

2.5 We deliver the goods within the timeframe indicated in the summary of your order. The delivery timeframe starts from the receipt of your payment. If we are prevented from making the delivery due to force majeure or a fortuitous event, the delivery timeframe is extended according to the duration of the impediment.

2.6 We draw your attention to the fact that we are exempt from delivering the goods ordered if we have ordered the goods properly but have not been supplied in time by our suppliers. Exemption from delivery also requires that the unavailability of the goods not be attributable to us, that we have not expressly agreed to bear the risk of supply and that we have informed you of the unavailability of the goods as quickly as possible. When the aforementioned conditions are met, the order is canceled and we will refund you the sums you have already paid.

2.7 Our obligation to deliver is limited to goods which we have in stock or which we have ordered from our suppliers. We ship worldwide.

3. PRICES, DELIVERY COSTS AND EXPRESS DELIVERY

3.1 We charge you for the products based on the prices specified in the offer at the time of the order. The prices specified are the final prices, all taxes included at the legal rate in force. The goods remain our property until full payment of the sale price.

3.2 The prices of the products displayed on www.innocence.boutique do not include delivery costs. In fact, depending on the amount of your order or the delivery method you have selected, you may be billed for delivery costs (see Shipping and Returns for a summary).

3.3 For France and the EU, innocence.boutique bears your delivery costs, excluding UPS delivery costs.

If you select delivery by UPS, delivery is free from € 150 of purchase. Below this amount, additional costs of € 7 will be charged.

For the rest of the world, innocence.boutique bears the delivery costs from € 200 of purchase, excluding UPS delivery costs. Below € 200 of purchase, delivery costs of € 10 will be charged.         These additional costs will be specified during the payment process and will be added to the total amount due.

If you select delivery by UPS, delivery is free from € 200 of purchase. Below this amount, additional costs of € 15 will be charged

3.4 After delivery, you are required to immediately check whether it is complete and whether the goods are damaged. Any complaints must be issued without delay to the transport company. You must also make sure that the delivered goods comply with your order. In case of non-compliance of the goods with the order, you must inform our customer department by email to innocencebyc@gmail.com

4. PAYMENT

4.1 We accept the following payment methods: credit card via our secure site, checks and cash in the event of an appointment at our showroom.

Depending on each order, however, we reserve the right not to offer certain payment methods or to offer alternative methods. All fees related to your payment are your responsibility.

4.2 In the event of a credit card purchase, your account is debited on the day your order is shipped.

4.3 You agree to receive invoices and credit notes in electronic form only.

5. LEGAL RIGHT OF WITHDRAWAL WHEN PURCHASING AN ARTICLE

When purchasing innocence.boutique items, you have a legal right of withdrawal.

5.1 Information on the right of withdrawal:

You have the right to withdraw from your contract without stating any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.

To exercise the right of withdrawal, you must notify us (Innocence, 1 bd Gambetta, 67000 Strasbourg, France, email: innocencebyc@gmail.com) of your decision to withdraw from this contract by means of a clear statement (e.g., letter sent by post or email).

If you make use of your right of withdrawal, we will send you an acknowledgment of receipt without delay (e.g. by email).

To respect the withdrawal period

(i) you must send us your declaration of withdrawal before the expiry of the said period;

(ii) the products must not have been used, stained or damaged;

(iii) the products must be returned intact and unused.

5.2 Exception to the application of the right of withdrawal

In accordance with Article L. 221-28 paragraph 5 of the French Consumer Code, the legal right of withdrawal is void in the case of sealed articles which have been opened after their delivery and which cannot be returned for reasons of health or hygiene.

5.3 Effects of withdrawal

In the event of a valid withdrawal, we will refund you for all payments received from you, excluding the delivery costs, without delay and at the latest within fourteen (14) days from the day on which we became aware of your declaration of withdrawal. We will process the refund using the same payment method you used, unless we expressly agree to a different payment method. The refund is free of charge for you. We reserve the right to withhold refund until we receive the good.

You must return or return the goods to us without delay and, in any event, no later than five days from the day on which you issue your declaration of withdrawal to us.

In any case, the return costs are your responsibility.

You must bear the loss in value of the returned merchandise if this loss in value is due to handling other than that which was necessary to ensure the nature, characteristics and proper functioning of the merchandise.

6. REFUNDS

Any refund from us will be made to the account you used to make the payment. In the event of payment by bank transfer, the sum is transferred to the account from which the transfer was made. If you paid by credit card, the amount will be refunded to the bank account linked to this payment method.

8. LEGAL WARRANTY AND OTHER INFORMATION

8.1 Only people aged 18 or over can use the offers available on www.innocence.boutique.

8.2 Each customer is only entitled to have one account at a given time with Innocence. We reserve the right to delete multiple registrations.

8.3 Sales made through the site www.innocence.boutique are subject to the conditions of the legal guarantee of conformity provided for in Articles L.217-4, L.217-5 and L.217-12 of the French Consumer Code as well as '' the legal guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code. 9. AMICABLE SETTLEMENT OF DISPUTES

Pursuant to Article L. 612-1 of the French Consumer Code, "Every consumer has the right to have recourse free of charge to a Consumer Ombudsman with a view to the amicable termination of the dispute between himself and a professional.". This covers disputes of a contractual nature, relating to the performance of a contract of sale or supply of services, between a consumer and a professional.

In case of difficulties, we invite you to contact our after-sales department beforehand. If your problem is not solved, you may use the services of an ombudsman within one year of receipt of your request by the after-sales department, with a view to out-of-court settlement of the dispute. To achieve that, you may contact the following mediation services:
